Your signature on the TFBnet application or use of any TFBnet service construes acceptance of these Terms and Conditions which supersede all previous representations, understandings or agreements and shall prevail notwithstanding any variance with terms and conditions of any order. TFBnet makes no warranties of any kind, expressed or implied, for services provided. TFBnet disclaims any warranty of merchantability or fitness for a particular purpose. TFBnet is not responsible for any damage suffered from the direct or indirect use of its services. This includes, but is not limited to: expenses and loss of data resulting from delays, nondeliveries, misdeliveries, or service interruptions caused by its own negligence or errors or omissions. Use of any information obtained via TFBnet is at your own risk. TFBnet specifically denies any responsibility for the accuracy or quality of information obtained through its services. TFBnet offers local Toll-Free access numbers as an additional benefit to its subscribers. TFBnet makes no guarantee towards the current, or future, availability of said Toll-Free access numbers. Hosted material is backed up daily, however no guarantee is implied as to the condition of stored information should a recovery be needed or requested. TFBnet recommends that you backup any critical data or information with your own devices. |
RESTRICTIONS. TFBnet may only be used for lawful purposes. Transmission or storage of material in violation of federal, state or local regulation is prohibited. This includes, but is not limited to material that is: copyrighted, judged to be threatening, compromises security or privacy, or is protected by trade secret. TFBnet reserves the right to remove or modify, at its discretion, any material in violation of these policies. You agree to indemnify and hold harmless TFBnet from any claims resulting from your conduct and/or use of the service which damages you or another party. |
ACCEPTABLE USE. TFBnet reserves the right to refuse service to anyone at any time for any reason, specifically for abuse of network resources. You agree to comply with the rules and restrictions of any network or service you access via TFBnet, including but not limited to the Acceptable Use Policies for Usenet and Internet e-mail which expressly prohibit unsolicited advertising. If deemed in violation of Acceptable Use by TFBnet, your account will be terminated and you will be subject to a penalty of $1 (U.S.) per recipient of every unsolicited electronic message sent from your account(s) or through your connection to TFBnet. In addition, you agree and submit to U.S.C. Title 47 Section 227, specifically recognizing "telephone facsimile machine" in subsection (b) (1) (C) to define any computing device capable of transmitting or receiving information in electronic format. Each message in violation of this federal law carries at least a $500 (U.S.) penalty. |
Residential service is not to be used for business or for hosting electronic services without the express written permission of TFBnet. Residential users pay a reduced rate for network services due to the fact that their utilization should be lower than the average business customer. |
Resale of any access, connectivity, or service of or thru TFBnet without the express written permission of TFBnet is strictly prohibited. |

You agree to comply with the rules and restrictions appropriate to other networks or services connected directly or indirectly to TFBnet. |
PAYMENT OBLIGATIONS. In addition to setup charges and recurring subscription fees, TFBnet has the right to charge additional fees for email storage, file storage, network traffic, and access time that exceeds the base amount included with your account. Payment is due in advance of the service provided, and is payable within fifteen (15) days from the account anniversary (the date it was established). If payment is not received within fifteen (15) days of the due date, the account is in default and subject to deactivation with a $15 (U.S.) reactivation charge. Such interruption does not relieve you from paying past due and ongoing charges. Advanced Services are provided on an annual (365-day) renewable term basis. Early termination of Advanced Services, for any reason, incurs a penalty of 50% of the fees remaining for the term. |
TERMINATION AND CANCELLATION. TFBnet reserves the right to terminate an account at any time for any reason. Setup charges and prepaid accounts are not refundable for any reason. |
Cancellation notices must be delivered via email, US Mail or fax. A confirmation of receipt for a notice to cancel services will be issued upon our receipt of said notice. Only a properly delivered cancellation notice and a confirmation of said notice will relieve the customer of any obligations to pay further account charges beyond any requisite advance notice polices. In absence of any superceeding contractual obligations, all cancellation notices require a 30-day advance notice. |
Business accounts closed within thirty (30) days of establishment may request reimbursement for fees paid in advance of service (excludes setup fees or other charges) and will be prorated based on the service fee schedule for the period of service provided. |
If you default, you agree to pay TFBnets reasonable expenses, including attorney and collection fees, to enforce its rights under the Terms and Conditions of TFBnet as an Internet Service Provider. |
TFBnet reserves the right to market any services or offers to its customer base, including but not limited to email messages, web-based messages and printed material included in any mailings. TFBnet does not and will not offer nor provide our customer information to any outside source for the purpose of marketing by an outside entity. |
